This document is an offer to enter into a public agreement between Tobto and the User. The agreement is public, meaning its terms are the same for all users, regardless of their status (individual, legal entity, or sole proprietor), without giving preference to any user. By accepting this offer, the User fully agrees to its terms. The agreement is considered concluded when the "Register" button is clicked in the User's Personal Account. "Tobto" refers to the sole proprietor Mykola Ihorovych Makukha (registration number 3282714732).
Tobto provides access to a platform for hosting, organizing, storing, transmitting, and sharing photographic materials via online galleries. Each gallery has a unique link generated when uploading a series of materials, which the User may share with clients at their discretion.
By accepting this offer, the User confirms they hold all rights to the uploaded photographic materials. Tobto is not responsible for any materials uploaded by the User and does not pre-screen them. If a complaint is received, the administrator may remove materials that infringe copyright, are illegal, threatening, offensive, contain viruses or harmful code, or otherwise violate this Agreement. Tobto is not responsible for malfunctions or delays caused by circumstances beyond our control. By using the platform, the User waives any claims arising from these situations. Access to Tobto features is granted within one business day after payment is received. Tobto ensures the platform operates 24/7, except during scheduled maintenance. User data is kept confidential, except for banking data, which is the responsibility of the payment gateway: JSC "UNIVERSAL BANK," EDRPOU code 21133352, operating under the trademark "Plata by mono." Subscription fees are shown on https://tobto.io in Ukrainian Hryvnia (UAH). Prices in foreign currency (USD) are approximate. Final prices in UAH are displayed on the payment page and recorded in the payment system invoice. Service fees do not include bank or payment system charges. Payments are processed automatically according to the chosen subscription plan using the verified payment method. Tobto may suspend access in case of late payment or during scheduled or emergency maintenance.
All photographic materials on Tobto are protected by copyright, trademarks, patents, and other property rights, and remain the exclusive property of their authors. Users may not copy, modify, reproduce, download, republish, distribute, or transmit materials without the author's written consent. Users are responsible for any unauthorized use of copyrighted materials.
We take all necessary measures to protect data from unauthorized access, alteration, disclosure, or destruction. These measures include internal audits, encryption, and physical security to prevent unauthorized access to our systems. Detailed information is available at https://tobto.io/privacy.
Users are solely responsible for keeping their account and password confidential, as well as for any actions or omissions resulting from their use. Tobto is not responsible for technical failures or data loss on servers storing User data (including photographs). We use servers from leading technology companies, which implement modern data protection standards, including regular backups, fault-tolerant storage, and other measures to minimize the risk of data loss. For all disputes, Users should contact Tobto Technical Support. Disputes not resolved amicably will be settled in court.
This Agreement takes effect upon acceptance and remains in force until the User's Personal Account is deleted. If a subscription payment is overdue, Users have 90 days to restore it. If the subscription is not restored within this period, all uploaded files will be deleted, and the account will be switched to the free plan (FREE). Account deletion occurs only through Support upon the User's request. After deletion, the User will no longer have access to Tobto services. This Agreement is originally drafted in Ukrainian. For convenience, an English translation is provided. In case of discrepancies, the Ukrainian version shall prevail.
